Equal Pay Act (EPA) Employment Cases
Equal Pay for Equal Work
In 1963 the Equal Pay Act amended the federal Fair Labor Standards Act to require that employers pay their workers equally without regard to gender, thus prohibiting gender-based pay discrimination. Since that time there has been an emergent body of law that seeks to address and prevent this type of discrimination. If you believe that you or someone you know is a victim of gender discrimination at work, at the law firm of Moody & Warner a knowledgeable Los Angeles employment law attorney is standing by to talk with you. We look forward to sitting down with you, discussing your concerns and advising you about the type of assistance we may be able to provide. Discrimination in pay based solely on gender is prohibited by numerous laws including Title VII of the federal Civil Rights Act, the California Pay Act and the federal Equal Pay Act. The language of the Equal Pay Act is specific about requirements that must be followed with regard to pay issues. Its provisions state that employers and unions must pay the same wage to all workers in jobs requiring "equal skill, effort and responsibilities performed under the same working conditions," whether they are male or female workers. Employers are not permitted to reduce wages of either sex to equalize pay. Gender discrimination occurs if this provision is violated and in that situation, it may be necessary to file a complaint to the federal Equal Employment Opportunity Commission (EEOC) or the California Fair Employment and Housing Commission in order to get justice.
